Terms and Conditions
Note: These terms and conditions are a template. Enter your company details in the [square brackets]. We expressly recommend having the terms reviewed by a German lawyer or a service such as Händlerbund / Trusted Shops Legal before use — incorrect or missing terms can lead to costly warning letters (Abmahnungen) in Germany.
§ 1 Scope
The following general terms and conditions (T&Cs) apply to all orders placed through our online shop by consumers and businesses.
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession. A business is a natural or legal person or a partnership with legal capacity that, when concluding a legal transaction, acts in the exercise of its trade, business or profession.
With respect to businesses, these T&Cs also apply to future business relationships without us having to refer to them again. If the business uses conflicting or supplementary general terms and conditions, their applicability is hereby rejected; they only become part of the contract if we have expressly agreed to them.
§ 2 Contracting party, conclusion of contract
The purchase contract is concluded with:

By clicking the order button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order is sent together with acceptance of the order immediately after submission by automated email. The purchase contract is concluded with this email confirmation.
§ 3 Contract language, storage of contract text

§ 7 Transport damage
If goods are delivered with obvious transport damage, please report such faults to the carrier as soon as possible and contact us as quickly as possible. Failure to make a complaint or to contact us has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, you help us to be able to assert our own claims against the carrier or transport insurer.
§ 8 Warranty and guarantees
Unless expressly agreed otherwise, the statutory liability rights for defects apply. For used goods, in deviation from the statutory provision: The limitation period for claims for defects is one year from delivery of the goods. The shortening of the periods does not apply to claims for damages based on injury to life, body or health or to essential contractual obligations, nor to damage based on grossly negligent or intentional breach of duty or fraudulent intent.
For businesses, the limitation period for claims for defects in newly manufactured goods is one year from the transfer of risk.
Any guarantees granted by us or the manufacturer beyond this will be communicated to you together with the product in separate guarantee conditions.
§ 9 Liability
For claims based on damage caused by us, our legal representatives or vicarious agents, we are always liable without limitation
- in the event of injury to life, body or health,
- in the event of intentional or grossly negligent breach of duty,

- insofar as the scope of the Product Liability Act applies.
In the event of a breach of essential contractual obligations whose fulfilment is what makes the proper performance of the contract possible in the first place and on whose compliance the contracting party may regularly rely (cardinal obligations) due to slight negligence on the part of us, our legal representatives or vicarious agents, liability is limited in amount to the foreseeable damage typical for the contract at the time of conclusion of the contract.
Otherwise, claims for damages are excluded.
§ 10 Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 11 Final provisions
